Your New Orleans Pedestrian Accident Lawyers

Physical fitness is a frequent topic in today’s news, but it’s been a strong concern of this nation since the days of President Kennedy. In the early 1960s, President Kennedy carried out initiatives focusing on the physical health of Americans. Ever since then, many Americans have stopped taking their health for granted and are finding ways to become healthier, including cycling and walking. This has also been affected by the eco-minded society of today, with many people walking or bicycling to work.

Cycling and walking are great for your health, but you are in a very vulnerable place if you are hit by a vehicle.

Because a pedestrian or bicycle accident can create multiple issues and significant losses, accident victims should hire an experienced New Orleans personal injury lawyer whose firm concentrates on such accidents. You should also look for a legal team with the resources necessary to manage an injured person’s medical needs, as well as the hiring of experts from a variety of fields to increase the value of any settlement.

Pedestrian Accident

Claim Process

Get Medical Treatment

Since there is no way for pedestrians to protect themselves, many of these accidents are serious and can even be fatal. Whenever there has been an accident between a pedestrian or cyclist with a car, the very first thing to do is to immediately seek medical attention for your injuries. Even if there are no outward signs of injury, it is still important to get medical attention because there is always a chance of internal injuries. Always be careful with injuries from these types of accidents and immediately seek the needed medical help.

01

STEP

Gather Evidence

Keep relevant medical records from any injuries associated with the collision, and try to get documentation from the scene of the accident, such as statements from witnesses or pictures of any aspects that may have played a role in the event. Write down your own version of events as soon as you can to ensure you have a clear, permanent record you can refer back to. These documents can be evidence to prove the driver is at fault and that the accident caused your injury. Without proper evidence, the insurance company may argue that the driver couldn’t have prevented the accident or that your injury was caused by something else.

02

STEP

Contact a Law Firm

If you’ve been struck by a vehicle while walking, cycling, or simply standing on the sidewalk, it’s time to talk to an experienced pedestrian accident attorney for help. An experienced attorney can help you get the necessary evidence to prove your right to compensation and help you take all the right steps to file a successful personal injury claim. Plus, most personal injury attorneys work on contingency, which means we only get paid if and when you do. Whether or not you need our services, we can let you know your legal options during your FREE consultation.

03

STEP

File a Claim

If the at-fault driver was properly insured, you should be able to file a claim with their insurance provider to recover compensation. However, keep in mind that these cases can be complex, and it’s still a good idea to get help from an attorney, even if you don’t think you’ll need to file a lawsuit. Things could be more complicated than they seem, and you may need to file an internal appeal with the insurance company after any rejections. An attorney can help you determine the next steps in your case.

04

STEP

Take Legal Action

If the insurance company will not cover your claim, or the driver was uninsured, it’s time to begin legal proceedings. The process generally starts with a demand letter notifying the at-fault party of your intent to sue and your compensation claims. This may be all it takes to get a fair settlement. If the insurance company doesn’t budge, it’s time to file a lawsuit. Through this legal claim, you can seek to recover compensation for things like lost income, permanent injury, medical expenses, and property damage. An attorney can help you get fair compensation.

A woman texting and driving

As a pedestrian, there is little you can do if you are in the way of a moving vehicle. All of these and many more situations can lead to collisions between cyclists and motor vehicles.

  • Distracted driving
  • The driver makes turn when it is time for the cyclist to go
  • A driver does not look both ways.
  • A driver fails to follow basic traffic laws
  • The driver backs up in a parking lot
  • The driver is unnecessarily speeding

If people paid attention to these simple things while on the road, it could lead to safer walking conditions for pedestrians.

Injured pedestrians in these types of accidents may be able to seek compensation for the following losses, depending on the nature of the accident:

  • Medical care for injuries
  • Future medical bills
  • Lost wages and income
  • Physical and mental pain and suffering
  • Permanent disability

In pedestrian accident cases, victims tend to suffer serious injuries, with many facing life-long and catastrophic injuries. A few common pedestrian injuries include:

  • Traumatic brain injuries
  • Spinal cord injuries
  • Broken bones
  • Damage to vital organs
  • Road rash and abrasions
  • lacerations

Injuries sustained from a vehicle while on a bicycle are never good and may cause life-altering consequences. It is necessary to have a skilled New Orleans attorney on your side to show that the driver is at fault.

Many cruise ship injury lawsuits must be filed in Florida. However, some cruise lines require a suit to be filed in California, so it is crucial to review the ticket contract before making a claim for your damages. Each cruise line’s contract may contain a different waiver of jurisdiction.

FREQUENTLY ASKED

QUESTIONS

There are certain laws that both cyclists and pedestrians need to follow. The judge or jury will look to these factors when assessing who is at fault for the collision. If you were not abiding by these laws, your right to compensation may be forfeit:

For Cyclists

  • Louisiana law requires a bicycle operator or passenger under the age of twelve years to wear a helmet when riding a bicycle.
  • It also requires a passenger who weighs less than forty pounds or is less than forty inches in height to be properly seated in and adequately secured in a restraining seat.
  • LA R.S.§32:197 also mandates that every person operating a bicycle upon a roadway shall ride as near to the right side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction, except under any of the following circumstances: (1) When overtaking and passing another bicycle or vehicle proceeding in the same direction, (2) When preparing for a left turn at an intersection or into a private road or driveway, (3) When reasonably necessary to avoid fixed or moving objects, vehicles, bicycles, pedestrians, animals, surface hazards, or substandard width lane or any other conditions that make it unsafe to continue along the right-hand curb or edge of the roadway, or (4) When approaching a place where a right turn is authorized.
  • Also, for a cyclist, it is important to stay in the designated bike lanes, to check the brakes on a daily basis, and to have the proper lights on the bicycle.

For Pedestrians

  • Louisiana law states that where sidewalks are provided, it shall be unlawful for any pedestrian to walk along and upon an adjacent highway.
  • Where sidewalks are not provided, any pedestrian walking along and upon a highway shall, when practicable, walk only on the left side of the highway or its shoulder, facing traffic which may approach from the opposite direction.
  • It is also against Louisiana law for any pedestrian to cross an interstate highway, except in the case of an emergency.

It is important to have a skilled New Orleans attorney on your side who knows the ins and outs of the law to represent your case and get a favorable outcome.

In Louisiana, personal injury victims generally have two years from the date of their accident in which to file a lawsuit. However, if your case involved a wrongful death, you may only have a single year in which to take legal action. If you’re not sure how long you have left to file a suit in your case, reach out to us for your FREE case review.

The majority of personal injury lawyers offer their legal services on a contingency fee basis. What this means is that the payment for our services comes as a part of your eventual settlement, rather than coming out of your pocket. In other words, we don’t get paid unless you do.
