How long do I have before I have to file a claim?

The time period that requires when a lawsuit must be filed depends on the nature of the case. In Louisiana, the prescriptive period (statute of limitations) is generally one year for most injury cases. You should contact our law firm as soon as possible to protect your rights and help make the decision as to whether to file suit.

How much does it cost for the Cardone Law Firm to represent my case?

The Cardone Law Firm represents most of their clients through a contingency fee contract. A contingency fee contract means that you pay nothing upfront, and we cannot collect a fee unless we win or settle your claim. The typical contingency fee is one-third (1/3) of any recovery that is obtained for you.

What types of damages are recoverable in a personal injury lawsuit?

Compensation may be recovered for bodily injuries, past and future effects of injuries on the injured party's overall health and function, past disfigurement, future disfigurement, past physical pain, future physical pain, mental distress or anguish, inconvenience, past, present, and future medical costs, lost past wages or earnings, lost future earnings capacity, loss of consortium, loss of domestic or household services, and damage to property. If a person dies from a personal injury then the family will also be allowed to recover damages for their loss of care, comfort, guidance, mental pain and suffering, funeral expenses, and support provided to the family members by the deceased. In addition, they would be allowed to recover any medical bills and the established loss of earnings. The deceased would be entitled to recover for such losses as: pre-death pain and suffering, pre-death terror, and mental anguish among other losses.

Are witnesses necessary?

It is not a necessity to have a witness; however, if there is one then it will strengthen the foundation of your personal injury case. It is extremely important, if possible, to get statements as well as the name, number, and address of anyone who witnessed an incident. Also, most personal injury cases should have experts to assist with an investigation and to analyze the information for potential testimony on liability.

Should I get Uninsured/Underinsured insurance coverage?

YES! This type of coverage is very important and will help you if you have been hit by a person without car insurance or if their insurance is not sufficient to cover all of your losses arising from elements of damages such as past and future mental and physical pain and suffering. This is very important to have since may people in Louisiana drive without insurance even though it is against Louisiana Law.

If I decide to file a lawsuit, will I have to go to trial?

It depends on the nature and circumstances of the case. If all the parties consent to a settlement then you will not have to go to trial. A settlement can happen at any time before the trial, during it, and even afterwards during the appeal process.

Can my Facebook or other social media website accounts be used against me?

Yes. Anything you post on the website can be easily obtained from the other lawyers and can be used against you. If you post videos or photos that show you doing activities that you claim you cannot due because of the injury then it will hurt your case. Therefore, be careful about what you post on the internet! Do not assist the insurance company prove its case against you!
